Welcome to Exec Homes & Co.

The terms “we”, “us” and “our” refer to Exec Homes & Co. Exec Homes & Co operates this store and website, including the information, content, features, tools, products and services made available through it (the “Services”).

Our online store is powered by Shopify, which enables us to provide our Services to you.

These Terms of Service, together with our Privacy Policy, Returns & Cancellations Policy, Shipping & Delivery Policy and any other policies referred to on our website, set out the terms on which you may use our Services and purchase products from us.

Please read these Terms carefully before using our website or placing an order.

By accessing or using our Services or placing an order with us, you agree to these Terms.

Nothing in these Terms limits or excludes any statutory consumer rights that cannot legally be excluded.


SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you confirm that you are legally capable of entering into a binding contract.

You may be asked to provide information including your name, email address, billing information, payment information and shipping information.

You agree that information supplied by you will be accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

You must not use our Services for any unlawful or fraudulent purpose.


SECTION 2 – OUR PRODUCTS

We make reasonable efforts to ensure that descriptions, photographs, dimensions, specifications and other product information displayed on our website are accurate.

However, colours and appearance may vary depending on photography, lighting, screen settings and the device used to view our website.

Many Exec Homes & Co products are handcrafted and/or manufactured from natural materials. Minor variations between individual products are therefore expected.

Natural Stone

Marble, onyx, quartzite, travertine and other natural stones are naturally occurring materials.

Variations in:

  • colour

  • tone

  • veining

  • mineral markings

  • pattern

  • texture

  • pores

  • natural fissures

  • crystalline structure

  • surface character

are inherent characteristics of genuine natural stone.

No two slabs, blocks or completed natural-stone products will be identical.

Product photographs, stone samples and previously manufactured pieces are representative of the material and design but cannot guarantee an identical distribution of colour, veins, markings or mineral movement in the finished product.

Normal variations inherent in natural stone are not, by themselves, manufacturing defects.

Handcrafted Products and Dimensions

Many products are individually cut, carved, shaped and finished by hand.

Dimensions stated on our website are nominal dimensions unless expressly stated otherwise. Small reasonable manufacturing tolerances may occur as a result of the handcrafted manufacturing process and the properties of natural materials.

Customers are responsible for confirming that the dimensions of a product are suitable for its intended location before ordering.


SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase products from Exec Homes & Co.

Your order is accepted when we issue confirmation that we have accepted it or, in the case of an individually agreed bespoke order, when the order/specification has been confirmed and manufacture has commenced.

We reserve the right to decline or cancel an order before acceptance where reasonably necessary, including because of:

  • an obvious pricing or description error

  • inability to obtain payment

  • product or material availability

  • inability to manufacture the requested specification

  • suspected fraud

  • legal or regulatory restrictions

If we cancel an order after taking payment and the goods will not be supplied, the appropriate amount paid will be refunded.

Please review your order carefully before submitting it.

Returns and cancellations are governed by our Returns & Cancellations Policy.


SECTION 4 – BESPOKE, MADE-TO-MEASURE AND PERSONALISED ORDERS

Exec Homes & Co specialises in bespoke and made-to-measure products.

A product will be considered bespoke or personalised where it is manufactured to a customer's individual specifications or requirements.

This may include products made with:

  • custom dimensions

  • customer-approved drawings

  • individually requested configurations

  • bespoke design modifications

  • customer-selected custom finishes

  • other individual specifications agreed before manufacture

Examples may include bespoke:

  • bathtubs

  • basins

  • vanity units

  • dining tables

  • coffee tables

  • side tables

  • worktops

  • architectural stone pieces

  • other custom natural-stone products

Customers are responsible for carefully checking all measurements, specifications, drawings and other details before approving a bespoke order.

Once a genuinely bespoke, made-to-measure or personalised order has been confirmed and manufacture has commenced, it cannot be cancelled or returned because the customer changes their mind, subject always to applicable consumer law.

This restriction does not affect your statutory rights where goods are faulty, damaged, incorrectly supplied, not as described or otherwise fail to conform to the contract.


SECTION 5 – PRICES AND PAYMENT

Prices displayed on our website may change without notice.

The applicable price will normally be the price shown when your order is placed or the price contained in an accepted written quotation.

We reserve the right to correct obvious pricing errors.

Any applicable delivery costs, taxes or other charges will be displayed or communicated as required before the order is completed.

For bespoke, trade or project orders, a deposit, staged payment or other agreed payment arrangement may apply.

Where manufacture is dependent upon payment or a deposit, production will not normally commence until the required funds have been received.


SECTION 6 – MANUFACTURING AND LEAD TIMES

Many Exec Homes & Co natural-stone products are individually manufactured to order.

Estimated manufacturing and lead times are displayed on relevant product pages or confirmed as part of an order.

Many made-to-order products have an estimated lead time of approximately 6–8 weeks, although this can vary depending upon the product, stone availability, dimensions, complexity and production requirements.

Lead times are estimates unless we expressly agree a guaranteed date in writing.

We will make reasonable efforts to keep customers informed of material delays.


SECTION 7 – SHIPPING AND DELIVERY

Delivery arrangements are governed by our Shipping & Delivery Policy.

Delivery times provided are estimates unless expressly agreed otherwise.

Delivery may be affected by manufacturing schedules, carrier availability, customs procedures, severe weather, port disruption, international transportation or other circumstances outside our reasonable control.

Risk During Delivery

For consumer orders where we arrange the carrier, products remain at our risk until they come into the physical possession of you or a person identified by you to take possession of the goods.

If you independently arrange a carrier that was not offered or arranged by us, responsibility may pass when the goods are delivered to that carrier in accordance with applicable law.


SECTION 8 – HEAVY AND OVERSIZED PRODUCTS

Many Exec Homes & Co products are exceptionally heavy.

This particularly applies to:

  • solid stone bathtubs

  • large marble basins

  • vanity units

  • dining tables

  • coffee tables

  • substantial side tables

  • worktops

  • architectural stone pieces

These products may require specialist freight, protective crates, pallets, lifting equipment and experienced handling personnel.

Customer Access Responsibilities

Before ordering, customers are responsible for ensuring that the product can reasonably be transported from the delivery point to its intended location.

Customers should check:

  • door widths

  • corridors

  • staircases

  • lifts

  • gateways

  • driveways

  • loading areas

  • access routes

  • ceiling and turning clearance where relevant

Customers should also ensure that suitable people and equipment are available to safely handle the product after delivery where these services are not included in the purchased delivery service.

Where a failed delivery, redelivery or additional specialist service is required because material access restrictions were not disclosed, reasonable additional costs may be payable where permitted by law.


SECTION 9 – STRUCTURAL SUITABILITY AND INSTALLATION

Solid natural-stone products can be extremely heavy.

The customer is responsible for ensuring that the intended installation location and supporting structure are suitable for the total installed load.

This is particularly important for:

  • stone bathtubs

  • wall-mounted stone basins

  • large vanity units

  • worktops

  • stone furniture

  • installations on upper floors

  • timber or suspended floors

Where appropriate, the customer should obtain advice from a qualified structural engineer, contractor or experienced installer before purchasing or installing the product.

Installation is not included unless expressly stated or agreed in writing.

Customers are responsible for arranging appropriately skilled professionals for lifting, plumbing, fixing and installation.

Exec Homes & Co will not be responsible for damage resulting from inappropriate installation, unsuitable structural support, incorrect handling, unsuitable fixings or unauthorised alteration, except where liability cannot legally be excluded.


SECTION 10 – DELIVERY INSPECTION AND DAMAGE

Customers should inspect the external condition of crates, pallets and packaging at delivery wherever reasonably possible.

Where visible transit damage is present, we recommend taking clear photographs before unpacking.

Products should be inspected as soon as reasonably possible after delivery.

If you believe an item has arrived damaged, incorrectly supplied or faulty, contact us promptly and provide:

  • your order number

  • photographs of the complete product

  • photographs of the affected area

  • photographs of the packaging

  • photographs of any visible damage to the crate or pallet

Please retain protective packaging until the issue has been reviewed.

Nothing in this section restricts your statutory rights.


SECTION 11 – RETURNS AND CANCELLATIONS

Returns are subject to our Returns & Cancellations Policy.

For eligible standard, non-bespoke products purchased online by consumers, statutory cancellation rights may apply.

For eligible UK distance sales, consumers generally have 14 days after receiving the goods to inform us that they wish to cancel and a further 14 days to return them.

Bespoke, made-to-measure and clearly personalised products are subject to the applicable statutory exemption from change-of-mind cancellation rights.

Heavy natural-stone products must not be returned without first contacting our Returns Department because specialist transportation may be required.


SECTION 12 – FAULTY OR NON-CONFORMING GOODS

Nothing in these Terms limits your legal rights relating to faulty goods.

Products supplied to consumers must meet the standards required by applicable consumer law.

Where goods are genuinely faulty, damaged, incorrectly supplied, not as described or otherwise fail to conform to the contract, we will provide an appropriate remedy in accordance with applicable law.

Depending upon the circumstances, this may include repair, replacement, price reduction or refund.


SECTION 13 – CARE AND MAINTENANCE

Customers must follow any technical, installation and care information supplied with the product.

Natural stone requires appropriate care.

Customers should avoid cleaning agents, chemicals, abrasive products or methods that are unsuitable for the particular natural stone or finish.

Damage caused by misuse, accidental damage, unsuitable chemicals, inappropriate installation, improper care or unauthorised modification is not considered a manufacturing defect.


SECTION 14 – TRADE, DESIGNER AND COMMERCIAL ORDERS

Exec Homes & Co also supplies products to:

  • interior designers

  • architects

  • developers

  • contractors

  • hospitality businesses

  • commercial clients

  • other trade customers

Where a customer purchases wholly or mainly for business purposes, consumer cancellation legislation may not apply.

Trade and project orders may be subject to separately agreed quotations, specifications, payment schedules or commercial conditions.

Where specific written commercial terms have been agreed for an order, those terms will take precedence over these general Terms to the extent of any conflict.

Bespoke and made-to-measure trade orders are non-cancellable once confirmed unless otherwise expressly agreed in writing or required by law.


SECTION 15 – INTERNATIONAL ORDERS

We supply products to customers in multiple international markets.

Customers are responsible for providing accurate information required for delivery and customs clearance.

Depending upon the destination and the shipping terms applying to the order, import duties, local taxes, customs charges, clearance fees or similar charges may apply.

Any mandatory consumer rights that apply to an international customer and cannot legally be excluded remain unaffected by these Terms.


SECTION 16 – INTELLECTUAL PROPERTY

Unless otherwise stated, the content available through our Services, including our brand name, text, photographs, product imagery, graphics, designs and other original material, is owned by or licensed to Exec Homes & Co and is protected by applicable intellectual-property laws.

You may use our website for lawful personal purposes.

You must not reproduce, commercially exploit, distribute, republish or materially modify our protected content without our prior permission except where permitted by law.

Nothing in these Terms grants ownership of Exec Homes & Co or Shopify intellectual property.


SECTION 17 – OPTIONAL TOOLS

We may provide access to tools or services supplied by third parties.

Third-party tools are subject to the terms and conditions of their respective providers.

We do not control third-party services and are not responsible for them except to the extent required by applicable law.


SECTION 18 – THIRD-PARTY LINKS

Our Services may contain links to third-party websites.

We are not responsible for the content, accuracy, availability or policies of third-party websites.

Customers should review the terms and privacy policies of third-party websites before using them or entering into transactions with them.


SECTION 19 – RELATIONSHIP WITH SHOPIFY

Exec Homes & Co is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases made through our Store are made directly with Exec Homes & Co.

Shopify is not the seller of the products offered by Exec Homes & Co and is not responsible for fulfilling purchases made directly from us.

Certain personal information may be processed by Shopify as described in our Privacy Policy and Shopify's own applicable privacy documentation.


SECTION 20 – PRIVACY

Personal information collected through our Services is handled in accordance with our Privacy Policy.

Because our website is hosted through Shopify, certain information relating to access to and use of the Services is also processed by Shopify and associated service providers as necessary to operate the ecommerce platform.

SECTION 21 – FEEDBACK AND REVIEWS

If you voluntarily submit reviews, photographs, feedback, suggestions or other content to us, you confirm that you have the right to provide that material.

You must not submit content that is unlawful, defamatory, infringing, fraudulent or contains malicious software.

Where you provide content for publication or promotional use, you grant Exec Homes & Co permission to use that content for legitimate business and promotional purposes, subject to applicable law.


SECTION 22 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally information on our website may contain typographical errors, inaccuracies or omissions relating to matters including product descriptions, pricing, specifications, availability, shipping charges or estimated transit times.

We may correct errors or update information when discovered.

Where an error affects an order that has already been placed, we will deal with the matter fairly and in accordance with applicable consumer law.


SECTION 23 – PROHIBITED USES

You may use the Services only for lawful purposes.

You must not:

  • use the Services unlawfully or fraudulently

  • infringe our intellectual property or the rights of another person

  • transmit malicious software or harmful code

  • attempt to interfere with website security

  • collect personal information unlawfully

  • impersonate another person or organisation

  • use automated methods to interfere with the Services

  • submit deliberately false or misleading information

We may suspend access where reasonably necessary to protect the website, our customers or our legitimate business interests.

We do not guarantee that the website will always be continuously available, uninterrupted or error-free.

We may temporarily suspend or modify parts of the Services for maintenance, security, technical or operational reasons.

This does not affect contractual obligations already owed to customers.


SECTION 25 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

In particular, nothing excludes liability for:

  • death or personal injury caused by negligence

  • fraud or fraudulent misrepresentation

  • breach of statutory consumer rights

  • any other liability that cannot lawfully be excluded

For consumers, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law.

We are not responsible for business losses suffered by a consumer where the purchase was made for personal purposes.

For business customers, additional limitations of liability may be contained in an agreed trade quotation or commercial contract.


SECTION 26 – EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for delay or failure caused by circumstances outside our reasonable control.

These may include:

  • natural disasters

  • severe weather

  • port closures

  • shipping disruption

  • industrial action

  • customs delays

  • international transport disruption

  • government restrictions

  • shortages of raw materials

  • events affecting manufacturing or freight networks

Where such an event materially affects an order, we will take reasonable steps to minimise disruption and communicate with the customer where appropriate.


SECTION 27 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue in effect.


SECTION 28 – WAIVER AND ENTIRE AGREEMENT

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

These Terms together with any policies, specifications, quotations or other terms expressly incorporated into an order form the agreement between us in relation to the relevant transaction.


SECTION 29 – ASSIGNMENT

You may not transfer your contractual rights or obligations to another person without our consent where consent is reasonably required.

We may transfer our rights or obligations where legally permitted, provided that doing so does not reduce a consumer's statutory rights.


SECTION 30 – GOVERNING LAW

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere, this does not deprive you of any mandatory consumer protections that apply to you under the laws of your country of residence.

Unless mandatory law provides otherwise, business customers agree that the courts of England and Wales shall have exclusive jurisdiction.


SECTION 31 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Services or applicable legal requirements.

The version displayed on our website at the time an order is placed will normally apply to that order unless a subsequent change is required by law.
